MINUTES – SPECIAL MEETING

Mayor James Rynberg called the Special Meeting to order at 8:36 AM.

Absent at Roll Call: Councilmembers Dick Conley and James Breinling
Staff Present: City Manager Chris Yonker and Director of Neighborhood & Economic Development Michele Ribant

Approval of Meeting Agenda
Councilmember Drake moved, seconded by Councilmember Breuker to approve the meeting agenda as distributed prior to the meeting with the addition of an item to consider the purchase of property at 10 W. Main Street; motion carried.

Authorize Change Order to Downtown NE Block Reconstruction Contract: Installation of Decorative Concrete in Easement Areas South of Alley
Councilmember Breuker moved, seconded by Councilmember Drake to authorize the above Change Order to install decorative concrete in the easement areas between the rear of the buildings and the public alley in the NE block of Downtown. Fleis & VandenBrink estimates the total cost to be approximately $72,822.78 as detailed in the firm’s cost analysis dated 6/21/07. This was a planned expense under the overall reconstruction project, with funding to come from the ’06 Capital Improvement Bond proceeds. Motion carried.
Authorize Purchase of Property at 10 W. Main Street
City Manger Yonker reported to the Council that a tentative agreement had been reached with the owner of 10 W. Main St., Ms. Lucia El Mansy, for the City’s purchase of the building. The 2-story building has been vacant for some time and is not being properly maintained. It is a key building in the southwest block of Downtown and the City’s intention in purchasing the building is
The City must still decide what efforts the City is willing to undertake, if any, prior to the re-sale of the property. Council will also need to determine the method of selecting a potential buyer, a sales price and any conditions or covenants on the re-use of the building. The intent is to secure retail/commercial space on the first floor with either residential or office use(s) on the second floor.
Councilmember Drake moved to authorize the City Manager to execute an Agreement for the Sale & Purchase of Real Estate at 10 W. Main Street at a purchase price of $100,000, subject to an acceptable Phase I Environmental Site Assessment, acceptable clear title and the payment by the Seller of all delinquent property taxes and City utility bills. Motion was seconded by Council-member Breuker and carried.
Authorize Execution of Easement Agreements (2) for Downtown NE Block Reconstruction of Privately-Owned Areas along and South of Public Alley
Councilmember Drake moved, seconded by Councilmember Breuker and carried to authorize the Mayor and City Clerk to execute two easement agreements for the properties owned by:
