MINUTES – REGULAR MEETING

 

Monday, May 7, 2007 – 7:00 PM

 

Mayor James Rynberg called the meeting to order at 7:00 PM.  Councilmember Larry Breuker gave the Invocation and led the Pledge of Allegiance to the American Flag.

Present at Roll Call: Mayor James Rynberg and Councilmembers Larry Breuker, Dick Conley, Jane Drake, and James Breinling .

Staff Present: City Manager Chris Yonker and City Clerk /Finance Director Todd Blake.

Public Present:  Jeffrey Barnes, Stan Nieboer, Ricky Kurnat, Jamie Lyons, Stephen Larson, Anastasia Bonczyk, Katie Moon, Steve Johnson and Kelli Green..

Approval of Meeting Agenda

Motion by Councilmember Breuker, seconded by Councilmember Conley to approve the meeting agenda, motion approved.

Consent Action Items

Motion by Councilmember Drake, seconded by Councilmember Breuker and carried, to approve the following Consent Action Items:

Accounts Payable Check Register Report dated May 3, 2007 totaling $490,064.07

Motion by Councilmember Drake, seconded by Councilmember Conley and carried to approve the May 3, 2007 Accounts Payable Check Register Report totaling $490,064.07.

Public Hearing: Confirmation of Special Assessment Roll for W. Main Street Improvements Sidewalk, Watermain & Streetlights.

Mayor Rynberg opened the public hearing at 7:05 PM.

Mr. Steve Johnson, of Freedom Chevrolet, reported that MDOT had not followed through as promised regarding his irrigation being left in good working condition, following construction completion.  City Manager Yonker noted he would contact MDOT and the project contractor to request that damaged irrigation lines located on Freedom Chevrolet’s private property be repaired.  Any lines within the State’s ROW were requested to be moved by MDOT and the prime contractor, K & R, Inc. Two weeks before construction began.  Damage to those lines is not reimbursable by MDOT or K & R.

Mayor Rynberg closed the hearing at 7:15.

 

Resolution R-07-09: Confirming Special Assessment Roll for W. Main St. Improvements between Dewitt Avenue and Industrial Drive

Staff reported that those parcels within Sheridan and Dayton Townships that are currently Phase 2 properties within the PA 425 Agreement would have their assessments held in abeyance until such time they request City utility services.  Following their request, assessments in abeyance would become due in full, without interest, before City services are activated.

 

Motion by Councilmember Breinling, seconded by Councilmember Breuker to approve Resolution R-07-09 confirming the “West Main Street Sidewalk, Watermain & Streetlight Improvements Special Assessment District”; motion approved.

 

Reports

City Manager Yonker announced that Cart-Right, LLC would begin its collection contract for residential curbside recycling for the City starting tomorrow, May 8th.  Allied Waste Services would be picking up its recycling bins at the same time & replacing them with the new blue 18-gallon “Fremont Recycles” bins purchased by the City.  Allied would not be picking up the original blue bins owned by the City from the beginning of the curbside program in 1992.

Mayor Rynberg requested suggestions for City appointment on the Fremont Area District Library Board to replace Arlene Frost, who has completed her permitted terms of office.

Councilmember Breinling announced the Farmers Market will open July 26th and run every Thursday evening (4-7 PM) and Saturday morning (7:30 AM – 12:30 PM) through mid-October.

The Following Communications were transmitted for Council Information:

Closed Session

Motion by Councilmember Drake, seconded by Councilmember Breinling to close the Regular Session at 8:10 PM and enter into a Closed Session to discuss pending litigation; motion approved by unanimous roll call vote.

The Closed Session ended at 8:20 and the Regular Session reconvened.

Adjournment

Motion by Councilmember Breuker, seconded by Councilmember Breinling to adjourn the meeting at 8:20 PM; motion approved.
