MINUTES – REGULAR MEETING

 

Monday, September 18, 2006 – 7:00 PM

 

Mayor James Rynberg called the meeting to order at 7:00 PM.  Councilmember James Breinling gave the Invocation and led the Pledge of Allegiance to the American Flag.

Present at Roll Call: Mayor James Rynberg and Councilmembers James Breinling, Larry Breuker, Dick Conley and Jane Drake

Staff Present: City Manager Chris Yonker, City Clerk/Finance Director Todd Blake and DPW Superintendent Brian Hettinger

Approval of Meeting Agenda

Motion by Councilmember Breinling, seconded by Councilmember Conley to approve the meeting agenda; motion approved.

Consent Action Items

Motion by Councilmember Breuker, seconded by Councilmember Breinling, and carried to approve the following Consent Action Items:

Minutes of the Regular and Closed Sessions held September 5, 2006

Councilmember Drake requested that in the 2nd to last sentence in the paragraph titled “Continued Council Review…” of the Closed Session Minutes:

Delete: “Neither the Council’s written review summary nor the Dept. Heads’ written survey summary was provided to the City Manager at the meeting, but were instead orally reviewed & summarized.”

Insert, in place of deletion: “The City Manager was informed of the Council’s consensus summary evaluation on each objective & behavior, and overall evaluation summary.  The City Manager utilized his opportunity to comment on the summary evaluations, and based on his input, the Council noted & approved revisions.  Highlights of the results of the Dept. Heads’ evaluation survey responses were also discussed.”

Motion by Councilmember Drake, seconded by Councilmember Breinling to approve the amended Minutes of the Closed Session held September 5, 2006; motion approved.

 

Motion by Councilmember Drake, seconded by Councilmember Conley to approve the Minutes of the Regular Session held September 5, 2006; motion approved.

 

Accounts Payable Check Register Report dated September 14, 2006 totaling $2,044,003.32

Motion by Councilmember Drake, seconded by Councilmember Conley to approve the September 14, 2006 Accounts Payable Check Register Report totaling $2,044,003.32; motion approved.

Public Comment

Ms. Rachele Crandell presented a plaque to the City Council, entailing pictures of her presentation of the American flag to the Mayor of Yahaba, Japan, and thanked the City for their donation of the flag for her school project.

 

Public Hearing: Downtown Development Authority (DDA) “Amended Development & Tax Increment Financing (TIF) Plan”

Mayor Rynberg opened the public hearing at 7:07 PM and welcomed citizen input. 

 

Mr. Ray Arnett, Fremont Area District Library Director, requested Council consider allowing the Library to opt out of future TIF captures by the DDA & LDFA.  Following brief discussion, Mayor Rynberg closed the hearing.

 

Public Hearing: Local Development Finance Authority (LDFA) “Amended Development & TIF Plan”

Mayor Rynberg opened the public hearing at 7:14 PM and welcomed citizen input.  Following brief discussion, Mayor Rynberg closed the hearing at 7:22 PM.

 

LDFA “Industrial Park Improvement Plan: Scope Definition & Preliminary Cost Projections”

Motion by Councilmember Breinling, seconded by Councilmember Drake to approve the Industrial Park Improvement Plan: Scope Definition & Preliminary Cost Projections as recommended by the Local Development Finance Authority; motion approved.

Resolution R-06-24: Adopting the LDFA “Amended Development & TIF Plan”

Motion by Councilmember Breinling, seconded by Councilmember Drake to approve Resolution R-06-24 adopting the LDFA “Amended Development & Tax Increment Financing Plans” as approved and recommended by the LDFA; motion approved by unanimous roll call vote.

Ordinance O-06-03: Adopting the DDA “Amended Development & TIF Plan”

Motion by Councilmember Drake, seconded by Councilmember Breinling to approve Ordinance O-06-03 adopting the DDA “Amended Development & Tax Increment Financing Plans” as approved and recommended by the DDA; motion approved by unanimous roll call vote.

Review of Bids for Harvesting of Timber on City Forest Properties

Wastewater Supervisor Mark Dezinski summarized the bid request process used for the harvesting of timber on City forest properties in Lincoln & Sheridan Townships.  He reported speaking with several foresters during the request period, but had not hired anyone to work on behalf of the City for this project.  He also noted the bid request notice specifically stated the City reserved the right to reject any and all bids.  He again recommended the City not accept any of the previously submitted bids for harvesting and that the City request bids at another time.

Mr. Bill Hawley informed Council that he believed he was hired as the City’s Forester for said project and expected to be paid 15% of the highest bid, regardless of the City’s decision to not accept any bid and delay the project.

Reports

City Clerk Blake reported the upcoming City Newsletter addresses Council’s desire for stricter enforcement on residential refuse cart pickup.  Following discussion, there was Council consensus to allow a refuse cart lid to be open 18” for pickup; otherwise the cart is in violation of City policy.

 

 

Mayor Rynberg reported a Yahaba delegation of students and teachers will visit Fremont on November 3rd and invited all Councilmembers to attend the luncheon in the Council Chambers.
